Home-Valuation Guarantee

SELLZ guarantees that your home will sell for an agreed value or higher when you list your home with the SELLZ® Team or you won’t owe listing compensation. This guarantee is only effective upon entering into an Exclusive Right-to-Sell Listing Agreement (the “Listing Agreement”) with a START Real Estate LLC agent within fourteen (14) days of receiving your Sellz Home-Valuation. The Listing Agreement will contain your Sellz Home-Valuation Guaranteed Listing Price (“Sellz Listing Price”) as well as other necessary disclosures and terms as required by the Colorado Real Estate Commission.  The agreed Sellz Home-Valuation Guaranteed Listing Price may not be the home-valuation price you see on Sellz website due to several factors that our algorithm cannot account for, such as updates or damage to your home, pandemics, loan qualification changes, HOA costs and special assessments, environmental factors, and other unique characteristics that can only be discerned with an in-person visit from a START agent.  You may also want to reduce your home valuation because you desire a quick sale.  At the end of the day, we want you to understand and be happy with your Sellz Home-Valuation Guaranteed Listing Price so that you can successfully sell your home by an agent who appreciates its value and is willing to put their compensation on-the-line.  Additional terms and conditions apply.*

SELLZ Home-Valuation Guarantee Additional Terms and Conditions.

SELLZ through START Real Estate (“START”) guarantees that your home will sell at the Sellz Listing Price or  higher or you won’t owe a listing commission.  This guarantee is calculated by comparing the Sellz Listing Price with the initial Purchase Price offered by a buyer.  The Sellz Listing Price is the Listing Price contained in your Listing Agreement.  There are no reductions of the Sellz Listing Price for concessions made by you to a buyer or buyer’s agent.  Your home may be advertised at a price higher or lower the Sellz Listing Price in order to obtain the maximum offer price for your home.  You are likely to receive several offers on your home at various initial Purchase Prices.  We anticipate that you will obtain offers that exceed the Sellz Listing Price.  Only the initial Purchase Price in an accepted offer will be used to calculate whether your sale qualifies for the SELLZ Home-Valuation Guarantee.

Guarantee calculation and examples. If you accept an offer from a buyer where the initial Purchase Price is the Sellz Listing Price or higher, you will owe your START agent the agreed upon compensation that is in your Listing Agreement.  If you accept an offer from a buyer where the initial Purchase Price is lower than Sellz Listing Price, you will NOT owe your START agent the agreed upon compensation that is in your Listing Agreement. 

This initial Purchase Price is discernable the moment you accept a buyer’s offer and will not be reduced under any condition for purposes of the SELLZ Home-Valuation Guarantee.

Here are some examples that you may encounter in your home purchase.

Example 1

You receive a SELLZ Home-Valuation of $500,000.  You sign a Listing Agreement with a START agent to list your home at $500,000.  This is your Sellz Listing Price.  A buyer makes you an offer for an initial Purchase Price of $500,000.00 and for you to pay the buyer’s agent $12,500, and you accept this offer.  You would owe your START agent a listing compensation because the initial Purchase Price was equal to the Sellz Listing Price.

Example 2

You accept the same offer as Example 1.  However, as part of the initial offer and accepted Contract, buyer requests you pay half of closing costs and pay for title insurance, taxes, or other costs.  These costs do not reduce the initial Purchase Price. You would owe your START agent a listing compensation because the initial Purchase Price was equal to the Sellz Listing Price.

Example 3

You accept the same offer as Example 1.  However, the buyer submits an Inspection Objection which requests a reduction of the Purchase Price of $10,000 as a concession for repairs in your home.  You agree and submit an Inspection Resolution to reduce the Purchase Price to $490,000.00.   You would owe your START agent a listing compensation because the initial Purchase Price was still $500,000.   A seller concession cannot reduce the initial Purchase Price.

Example 3 – The Guarantee

You receive a SELLZ Home-Valuation of $500,000.  You sign a Listing Agreement with a START agent to list your home at $500,000.  This is your Sellz Listing Price.  A buyer makes you an offer for an initial Purchase Price of $499,999.99 and for you to pay the buyer’s agent $12,500, and you accept this offer.  You would NOT owe your START agent listing compensation because the initial Purchase Price was lower than the Sellz Listing Price.

Successful Transaction Document Fee. All successful sales, regardless of whether you owe compensation to your START agent, are subject to a transaction fee which is incurred in every successful real estate transaction.  This fee is less than $750 per transaction and is only owed in the event of a successful closing.  This is the only fee you will pay START if your property sells for less than the Sellz Listing Price.  This fee is not compensation and is the only document fee START charges.

Limit of liability.  You agree that by using this website Sellz and START’s limit of liability concerning the SELLZ Home-Valuation Guarantee is limited to that of a typical listing broker’s compensation in the relevant market.  You agree that no other damages are appropriate or awardable outside the value of the listing broker’s compensation.
